1.1. These general conditions of sale, in their pro tempore drafting in force at the time of the order by the customer, regulate the sales made through the site of Ceramiche Dordini Srl, with registered office in Bagnolo San Vito (MN) at Via del Lavoro, 30, Tax Code and VAT number 02095830200, REA: MN 223652, Share Capital: 40,000.00 fully paid-up, in favor of consumers and / or professionals.
1.2. Any sale made through this site, if in favor of a consumer, is therefore governed by the Consumer Code (Legislative Decree no. 206/2005), articles 49 to 67.
1.3. When reference is made to the "Products" in these general conditions, it means the analytically identified and listed assets in the appropriate section of the Site.
1.4. The Customer is invited to print and / or keep these General Conditions according to the preferred methods.
1.5. In the interpretation of these general conditions, the terms indicated below, if written with a capital letter, will have the meaning for each of them indicated below:
1.5.a) "Ceramiche Dordini": Ceramiche Dordini S.r.l., with registered office in Bagnolo San Vito (MN) at Via del Lavoro 30, Tax Code and VAT number 02095830200.
1.5.b) "Customer": the natural or legal person who purchases the Products through the Order Procedure, whether he is a consumer or a professional (according to the definitions contained in the Consumer Code).
1.5.c) "General Conditions": these general conditions of sale for online purchases on the website www.caemdordini.it / www.arredobagnodordini.it.
1.5.d) "Order": the summary document of the Products selected by the Customer, with a description of the Products themselves and an indication of the relative prices, including Delivery Costs. The document will be generated in due time by the employees of the sales office, according to the choices made by the Customer. The Order will finalize a sales contract.
1.5.e) "Order Procedure": the process of electronic sending to Ceramiche Dordini, by the Customer, of an Order, placed through the Site and relating to the purchase of Products.
1.5.f) "Products": the products sold by Ceramiche Dordini, as listed on the Site, among which the Customer can select those of his liking to be included in the Order.
1.5.g) "Site": the website www.caemdordini.it or www.arredobagnodordini.it, on each of its pages.
1.5.h) "Delivery Costs": the costs of transporting the Products indicated in the Order.
2.1. The indication of the Products on the Site constitutes an offer to the public. The Customer who intends to purchase one or more Products can confirm the estimate received, and send Ceramiche Dordini a written confirmation accompanied by a deposit or balance, based on the agreements made. The sales contract will therefore be finalized only when Ceramiche Dordini has received and correctly accounted for the down payment / balance referring to the Customer's Order.
2.2. It is also understood that the contract is finalized but is conditionally suspended until the total availability of the goods in the warehouses of Ceramiche Dordini or the suppliers and full payment by the customer are ascertained.
3.1. All prices displayed on the site are net of VAT.
3.2. Delivery costs are charged to the customer; they are calculated automatically according to the quantity of the selected Products and their destination. In the Order, the Customer finds explicit mention of the Delivery Costs.
3.3. The Order will indicate, for each Product, the price shown on the Site or displayed by a Commercial Operator at the time of confirmation of the dispatch, without any consideration of previous offers. Obviously, any subsequent price changes will not be applied to sales already completed.
4.1. Orders must be made in writing by e-mail in response to the Offer sent by a Commercial Operator. The Customer can rely on the correct completion of the Order Procedure only when he has received the Order Confirmation.
4.2. Whenever the Order is correctly forwarded, a sales contract between Ceramiche Dordini and the Customer will be considered finalized, concerning the Products requested / selected by the Customer. Once a sales contract has been completed, the Customer will receive the Order Confirmation by e-mail (also valid for the purposes of Article 51 paragraph 7 of the Consumer Code); it will be sent to the e-mail address communicated by the Customer. This Order Confirmation will summarize the selected Products, the relative Prices (including Delivery Costs), the address for delivery, the order number (hereinafter the "Order Number") and the special conditions applicable to the Order. The Customer undertakes to verify the correctness of the data contained in the Order Confirmation and to notify Ceramiche Dordini, within 24 (twenty-four) hours of receipt of the same, of any corrections. Failure to rectify it exempts Ceramiche Dordini from any liability and possible increase in expenses, caused by errors in the data not reported promptly, which will be charged to the Customer. The Order Number, generated by the system and communicated by Ceramiche Dordini, must be used by the Customer in any subsequent communication with Ceramiche Dordini.
4.3. The Customer is hereby informed that, at the time of the Order Confirmation, he will not receive an indication of the delivery date, and that the date and time of the actual delivery must subsequently be agreed with the carrier by Ceramiche Dordini in charge of deliver the goods to their destination.
5.1. Payment can be made as follows:
5.1.a) Through PayPal with the appropriate link indicated on the Site;
5.1.b) Bank transfer with the following methods: Beneficiary Ceramiche Dordini S.r.l., P.I./C.F. 02095830200 - IBAN: IT07E0503457840000000000636 - SWIFT (BIC): BAPPIT21263 (for bank transfers from abroad) - Reason: indicate the Quote Number.
5.2. In the cases under 5.1.b), the delivery of the goods can only be made after the transfer has been credited to the beneficiary's account, without prejudice to the provisions of Article 2) of these General Conditions on the subject of order cancellation.
5.3. Ceramiche Dordini will issue an invoice for the Products purchased. For the issuance of the invoice, the information provided by the Customer via e-mail or website will prevail. No changes to the data will be possible after the invoice has been issued.
6.1. Delivery, in a single solution, unless otherwise agreed in the order phase with the commercial operator, is carried out up to destination throughout the national territory (with the exception of the Venetian lagoon and the smaller islands) by specialized transporters appointed by Ceramiche Dordini. For deliveries in the Venetian lagoon and / or in the smaller islands, the Customer is invited to contact a Ceramiche Dordini operator to verify the feasibility of the transport, and to quantify the cost if possible.
6.2. Similarly, for deliveries outside the national territory and / or outside the European Union (except for the Republic of San Marino, for which the principles stated in relation to national deliveries will apply), the Delivery Costs will be quantified by Ceramiche Orders at the request of the customer. In calculating the Delivery Costs, any customs duties and / or any other limitation on the export of the Products will also be taken into account. The Customer will be free to place the Order or not once he is aware of the transport costs and times.
6.3. The unloading of the goods at the Customer must take place on the roadside, near the house number, in the most suitable place for unloading and accessible to heavy transport vehicles, where the vehicle is allowed to stop. If it is not possible to reach the address indicated due to impediments or particular conditions related to the access routes, delivery will take place at the closest point as far as the vehicle will be able to access (however, there is no porterage service at the street number). Porterage requests eg. delivery of goods in front of the entrance and / or in the atrium of the property, in the garage, in the private courtyard area, on the upper or lower floors cannot be accepted, unless previously agreed at the time of purchase, as an additional service.
Any additional service must be requested and paid for before delivery takes place.
The Customer obviously remains free to negotiate with the Transporter the delivery transport in the manner described above, fully bearing the costs and risks, which Ceramiche Dordini will not be responsible for in any case.
6.4. The unloading of the products, in accordance with the agreements made with the carrier, must be carried out by the latter using the latter's equipment. Ceramiche Dordini will not be liable for damages caused by the Customer if the latter, personally or through their auxiliaries, unloads the Products.
The disposal of pallets and packaging in general used for the delivery of the goods are the sole responsibility of the Customer.
6.5. Indicatively, the goods available will be delivered within 20 working days from the order confirmation (notwithstanding Article 61 of the Consumer Code), in any case the conditions referred to in points 2.2 remain valid. and 5.2.
As soon as the products ordered by the Customer have been delivered to the carrier, the latter will contact the Customer to give him notice. The delivery date of the goods will be fixed by agreement between the Customer and the carrier; it is specified that the Customer will have 5 (five) calendar days to accept the delivery from the moment of the telephone notice by the carrier. If the Customer intends to postpone the delivery, any storage costs will be at his expense. It should be noted that delivery is on a time slot, therefore a specific time cannot be agreed. The carrier, on the agreed date, will make only one delivery attempt. If the delivery does not take place, due to absence or in any case for reasons due to the Customer, the goods will return to the carrier's warehouse; it will be the Customer's concern to contact the carrier and agree with him the methods of collection of the material from the latter's warehouse. As an alternative to the aforementioned collection, the Customer can contact Ceramiche Dordini to arrange a new shipment, in which case the Customer will, before the same, reimburse Ceramiche Dordini the expenses incurred by this for the storage and the costs of redelivery of the goods. If for the delivery of the goods it is not possible to unload in a single solution, due to limitations in access to the place of destination, Ceramiche Dordini will be entitled to make split deliveries, giving notice to the customer.
6.6. The Customer must confirm that the place of delivery of the goods is easily accessible by means of transport and that the state of the same does not present particular impediments and / or limitations (e.g. ZTL area) for transport purposes. In case of failure to communicate if the transport involves a higher performance, the additional costs applied by the carrier will be charged to the Customer.
The Customer must confirm that the place of delivery of the goods is easily accessible by means of a vehicle equipped with a tail lift and that delivery and unloading will take place in an area of flat and asphalted surface, i.e. in the absence of differences in height that would compromise the tail lift (excluding the presence of gravel, dirt, pebbles, etc.). In case of failure to communicate if the transport involves a higher performance, the additional costs applied by the carrier will be charged to the Customer. Failure to communicate will not entail any responsibility for Ceramiche Dordini for non-delivery and it will be the Customer's responsibility to contact and agree directly with the same a new delivery of the goods.
6.7. In providing the data relating to the delivery address, the Customer certifies the authenticity and correctness of the same. The transport assignments will be fulfilled in accordance with the data provided, therefore in the presence of errors (by way of example incorrect postcode, address, place ect.) The Customer exempts Ceramiche Dordini from any liability and / or prejudice that may derive from it, including a cost charge. applied by the carrier for erroneous compilation and omitted information referred to in points 6.6 (since it is a matter of delivery of the goods outside the agreed agreements.) Any request for change of address, after confirmation of the order, must always be communicated in writing to Ceramiche Dordini; this could involve additional costs for the customer.
6.8. The Customer must verify the exact quantitative correspondence of the goods, or check that the quantity of packages, parcels and pallets ordered coincides with what is indicated in the DDT (transport document) and / or Accompanying Invoice. Otherwise, the Customer must put the reservation or the specific and motivated description of what was detected on the DDT or Accompanying Invoice. The Customer must check the condition of the packaging and the goods which must be perfectly intact, not damaged or altered. Otherwise, the Customer must put the reservation or the specific and motivated description of what was detected on the DDT or Accompanying Invoice. If this description is omitted, the reserve will have no value, therefore no claim or request can be asserted. The Customer who refuses to accept the delivery of the goods, because they are damaged, broken, or for any other reason, must also in this case affix the reserve or the specific and motivated description of what has been found on the DDT or Accompanying Invoice. The Customer, in consideration of the above, must always take photos at the time of delivery, which must show all the problems encountered, none excluded. In particular, the photos must show the damaged pallet, possibly with the shipping label showing the Carrier's information highlighted, before opening it and then the damaged packages on the open pallet. Once the specific and justified reservation has been made, the Customer must notify Ceramiche Dordini in writing at the following e-mail address: bagnolo@ceramichedordini.it. The aforementioned communication must necessarily be accompanied by the following documentation: photo, DDT or Accompanying Invoice. In particular (without prejudice to Ceramiche Dordini's responsibility for any damage occurring during transport), the Customer will have the responsibility of keeping the broken and / or damaged goods, refraining from disposal without the prior written consent of Ceramiche Dordini. Failure to comply with this provision could harm Ceramiche Dordini's right of recourse against its suppliers. No responsibility can be attributed to Ceramiche Dordini for delayed or non-delivery due to force majeure, by way of example: war, terrorism, government decree, authority provision, pandemic, earthquakes etc.
6.9. Pursuant to art. 1698 of the Civil Code, the Consumer has 8 (eight) calendar days from the date of delivery, to report any anomalies or hidden damage that is not recognizable and obvious upon receipt of the goods; it follows that after the aforementioned term has elapsed, no claim or right can be asserted against Ceramiche Dordini.
The Customer must send no later than 8 (eight) calendar days from the delivery of the goods to Ceramiche Dordini to the following e-mail address bagnolo@ceramichedordini.it. a communication containing the following information and documents: a) DDT and / or accompanying invoice; b) description of the damage and / or anomaly found; c) sending photos of the external packaging and damaged goods.
With the allowed technical times, Ceramiche Dordini will be responsible for replacing the disputed materials, provided that any defects or breakages exceed the legal 5% of the total supply and all the provisions listed in point 6.8 have been respected.
7.1. The Consumer has the right pursuant to the Consumer Code Legislative Decree n. 206/2005 and subsequent amendments and additions to withdraw from the contract within 14 days from the day on which the Consumer or a third party, other than the carrier and designated by the Consumer, acquires physical possession of the goods without any penalty and without having to provide any motivation.
To exercise the right of withdrawal, the Consumer is required to inform us of his decision to withdraw from this contract by means of an explicit declaration (for example a letter sent by post or e-mail).

To meet the withdrawal deadline, it is sufficient for the Consumer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
The right of withdrawal is exercised correctly if the following conditions are met:
• the purchased product must be returned intact and in its entirety and perfectly suitable for its intended use;
• the product must be complete in all its elements and in all its parts (including external packaging and original internal packaging, accessories, any documentation and provided with relative labels, identification tag, codes);
• at the time of return, the product must be returned as received by the Consumer upon delivery.
7.2. The Consumer is requested to send back the goods or to deliver them to our warehouse in Bagnolo San Vito (MN) in Via Nazario Sauro n. 3, without undue delay and in any case within 14 days from the day on which you communicated your withdrawal. The deadline is met if the Consumer sends the goods before the expiry of the 14 days.
The direct costs of returning the goods will be borne by the Consumer.
To this end, we specify the following: it is possible that the Consumer has purchased and wishes to return goods that, due to their size and weight, can normally be returned by post. However, it is possible that the size and / or weight of the goods that the Consumer wants to return are such as to prevent this method of return; in this case, we suggest that the Consumer contact a carrier in advance, as it is absolutely impossible for us to estimate the cost of transport in such conditions.
To avoid damage to the product and the original packaging, the latter must be covered with additional protective packaging to preserve the integrity of the goods during transport.
7.3. The risk of perishing of the goods is subject to the full responsibility of the Consumer, until the certificate of receipt of the goods at our warehouse, whether it is shipping or in the event that the goods are damaged for reasons other than their transport. .
7.4. We will proceed with the reimbursement within 14 days of receipt of the goods, unless we have successfully carried out the checks relating to the deadline for exercising the right of withdrawal, the integrity and suitability of the product and all the conditions listed for the correct exercise of the right of withdrawal.
7.5. In the absence of the essential condition of integrity of the goods and the additional conditions described above, the Consumer loses the right of withdrawal and the purchased product will remain available at the warehouse for collection by the Consumer. Ceramiche Dordini will notify you by means of a specific communication.
8.1. For any possible complaint, the Consumer must use the following e-mail address bagnolo@ceramichedordini.it. communicating and providing the following: order number, invoice, product and code of the same, quantity, subject and description of the complaint including supporting photos.
9.1. The Customer acknowledges and acknowledges that the goods being sold and in particular the ceramic products may have a slightly different color tone from that of the photos published on the Site. Since these are color differences tolerated in the trade of ceramic products and impossible to predict and / o prevent, it is understood between the parties that the delivery of material with a slightly different tone than the photos viewed online does not constitute a breach by Ceramiche Dordini.
9.2. Upon delivery of the goods, the Customer will check their conditions and will be required to report to the supplier those defects that the person of average diligence could have detected following a careful inspection of the goods themselves. The Customer is however required to report the presence of obvious defects in the goods within the terms of the law, and in any case before proceeding with the installation of the products. Ceramiche Dordini will not be responsible for the costs of installing products clearly flawed or different from what was agreed, nor for the costs necessary for the removal of such products and / or for the restoration of the premises and / or for any indirect damage and / or consequential that could be prevented by using ordinary diligence in examining the goods.
9.3. The Customer acknowledges and acknowledges that the sale of the Products through the Site is not primarily directed to any country outside Italy, and that indeed Ceramiche Dordini reserves the right to verify, case by case, the feasibility and costs. of the transport of Products outside their national borders. The translation of these general conditions does not represent a solicitation to purchase the Products directly outside national borders.
9.4. These general conditions are translated into several languages for reasons of mere courtesy; in any case of inconsistency between the different versions, the one in Italian must be considered prevalent.
9.5. Pursuant to Article 49, paragraph 5 of the Consumer Code, the information provided pursuant to Article 49, paragraph 1 of the same Consumer Code forms an integral part of the contract; these conditions cannot be modified except with the consent of both parties.
